Terms and Conditions

Welcome to ONTRAC Home Service Marketing (“we,” “us,” “our”). By accessing or using our website, services, or any related materials, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, please refrain from using our services.

1. SERVICES PROVIDED

ONTRAC Home Service Marketing offers digital marketing and creative services, including but not limited to website design and development, branding and graphic design, SEO (Search Engine Optimization) services, paid advertisement management (Meta Ads, Google Ads, etc.), social media marketing, and marketing consulting and strategy. We reserve the right to modify, discontinue, or expand our service offerings at any time.

2. PAYMENT TERMS

Payment is required as outlined in the signed proposal, contract, or invoice. Monthly services (e.g., SEO, advertising, website maintenance) are billed on a recurring basis, and payments are due on the agreed billing date. Late payments may result in a pause or termination of services until payment is received. For custom projects, a deposit may be required before work begins.

3. CANCELLATION & REFUND POLICY

Once work begins, no refunds will be issued. A 30-day written notice is required to cancel any monthly service unless otherwise stated in a longer-term contract. For one-time services, if canceled before work begins, there is no fee. If canceled after work has started, the client will be billed for work completed up to the cancellation date. Clients retain full ownership of completed work upon payment in full.

4. CLIENT RESPONSIBILITIES

To ensure smooth project execution, clients must provide all necessary materials (content, images, branding assets, logins, etc.) in a timely manner, respond to approvals and requests within a reasonable timeframe to avoid project delays, review and approve deliverables as needed, and ensure that all submitted materials (logos, content, media) do not infringe on any third-party rights. ONTRAC is not responsible for delays resulting from a client’s failure to provide necessary materials or approvals.

5. OWNERSHIP & INTELLECTUAL PROPERTY

Clients own all completed work (branding, designs, website files, ads, etc.) upon full payment. ONTRAC retains the right to showcase completed work in portfolios, case studies, or promotional materials unless a written confidentiality agreement is in place. Any work not paid for in full remains the property of ONTRAC Home Service Marketing.

6. THIRD-PARTY TOOLS & INTEGRATIONS

We may use third-party tools (Google Analytics, Meta Pixel, CRM software, hosting providers, etc.) to provide services. We are not responsible for downtime, policy changes, or errors caused by third-party services. Clients using paid advertising platforms (Meta, Google, etc.) are responsible for ad spend costs, which are billed directly by the platform.

7. WEBSITE MAINTENANCE & SECURITY

If we provide ongoing website maintenance, we ensure updates, security patches, and backups to keep the site running efficiently. We are not responsible for client-made errors that cause website malfunctions. Security measures are implemented, but no website is 100% hack-proof—clients should maintain proper security practices.

8. SEO & MARKETING PERFORMANCE

We follow best SEO practices, but we do not guarantee specific rankings or results. Search engines control ranking factors, and results may vary. For paid advertising, ONTRAC optimizes campaigns but does not guarantee a set number of leads, clicks, or conversions.

9. LIMITATION OF LIABILITY

ONTRAC is not liable for direct, indirect, incidental, or consequential damages resulting from the use of our services. We do not guarantee business success, as many external factors influence marketing effectiveness. Clients are responsible for compliance with legal regulations when collecting customer data through websites, ads, or other channels.

10. DATA PRIVACY & COMPLIANCE

We collect and store data in accordance with our Privacy Policy. If clients collect customer data (e.g., via contact forms), they are responsible for compliance with GDPR, CCPA, or other applicable privacy laws. Clients may request data modifications or removal by contacting support@ontracmarketing.com.

11. SERVICE MODIFICATIONS & TERMINATION

We reserve the right to modify or discontinue any service at any time. If services are discontinued, clients will be notified in advance and provided with relevant deliverables. ONTRAC reserves the right to terminate services due to non-payment, breach of contract, or misuse of services.

12. CHANGES TO TERMS & CONDITIONS

We may update these Terms & Conditions at any time without prior notice. Changes will be posted on our website, and continued use of our services constitutes acceptance of the updated terms.
